Privacy Policy
General
Everyone has the right to privacy and to protection against the misuse of their personal data. I comply with these provisions. Your personal data will be treated in the strictest confidence. In close cooperation with my hosting provider, I endeavour to protect your data as effectively as possible against unauthorised access, loss, misuse or falsification.
The protection of your privacy and your personal data is of particular importance to me. Below you will find full details of what data I collect and how I use it.
Legal basis for data processing
The legal basis for data processing is set out in the Data Protection Act. The primary focus is on processing directly related to the conclusion or performance of a contract (Section 31(2)(a) of the Data Protection Act) and credit checks and debt recovery efforts (Section 31(2)(c) of the Data Protection Act).
Disclosure to countries outside Switzerland is only permitted to countries with an adequate level of protection and therefore does not require any further conditions (Section 16(1) of the Data Protection Act). The various retention periods are based on my legitimate interests, in particular for evidential purposes (Section 31(1) of the Data Protection Act). The duration is determined by the applicable statutory provisions in each case.
Categories of personal data
Depending on the purpose, I process the following categories of personal data in particular:
- Contact details (e.g. name, address, telephone number, email address);
- Customer details (e.g. projects, contracts, details of individuals involved);
- Financial information (e.g. bank details, accounting data);
- Website data (e.g. IP address in the hosting provider’s server log files, date and time of access, browser type, anonymised statistics on website usage);
- Data from public sources (e.g. debt collection registers, credit reference agencies, commercial registers).
Purpose of data processing
As part of my work as an astrologer, I process various categories of personal data for a range of purposes. The following list is not exhaustive:
Conclusion and fulfilment of the contractual relationship
First and foremost, I process your personal data in connection with the conclusion and fulfilment of contracts with clients and business partners. This covers all services I offer as well as those agreed on an individual basis, in particular psychological astrology.
Communication
I process your personal data in order to be able to contact you and third parties by email, telephone or post.
Administrative matters
I process your personal data for administrative purposes, primarily for invoicing and bookkeeping. I also reserve the right to obtain additional data from third parties where this appears appropriate, primarily for credit checks.
Website operation and analysis
When you access my website, the hosting provider stores technical data in log files. This is necessary to establish the connection you have requested and to deliver the content. To measure website traffic, I use Fathom Analytics, which operates without cookies and does not store any personal data (see below).
Disclosure of personal data
I treat your personal data as strictly confidential. However, it may be disclosed to third parties provided that:
- you have given your consent,
- the processing is necessary for the performance of a contract with you,
- the processing is necessary to comply with a legal obligation, or
- the processing is necessary to safeguard legitimate interests and there is no reason to believe that you have an overriding legitimate interest in preventing the disclosure.
In order to fulfil the contract, I may disclose your personal data to data processors in the following categories:
- Communications service providers;
- Accountancy, fiduciary and financial service providers;
- Specialists and partner companies;
- Government agencies, debt collection agencies, courts and legal representatives;
- Hosting and cloud services, including those based abroad;
- Web analytics (Fathom Analytics).
Unless otherwise agreed with you, I only work with data processors who provide adequate data protection and data security guarantees in accordance with a contract or privacy policy, or who are subject to confidentiality obligations. Your data is processed both domestically and abroad, with data locations restricted as far as possible to countries offering an adequate level of protection.
Duration of data processing
I will retain your data for as long as is necessary to fulfil the purposes set out here, or as required by the retention periods under tax and commercial law. Once the purpose no longer applies or these periods have expired, I will delete or anonymise your data, unless you have consented to further processing.
Your rights as a data subject
As a data subject, you have various rights in relation to my processing of your data. You may at any time request information about your stored data and how it is processed, have inaccurate personal data rectified, request the erasure of your personal data, restrict processing where I am not yet permitted to erase your data due to legal obligations, object to the processing, or request that your personal data be transferred to other data controllers.
If you contact me, I reserve the right to verify your identity (e.g. by asking for a copy of your ID). Where this would involve a disproportionate amount of effort, I may request a contribution towards the costs of up to CHF 300.00. You would be informed of this in advance.
Where information is available, my reply will be sent electronically in PDF format. Otherwise, you will be informed that I do not process any data relating to you. Your enquiry and my reply will be retained for two years and then deleted. For evidential purposes, your enquiry will remain recorded in the log for the duration of the general statutory limitation period (including only your name, the date and the manner in which it was dealt with).
You may withdraw any consent you have given at any time with effect for the future. You may also lodge a complaint with the relevant supervisory authority at any time.
